Terms and conditions

1. Basic provisions

These terms and conditions govern the rights and obligations between the company ROON s.r.o., with its registered office at Letců 1003/8, Hradec Králové, 500 02, IČO: 27558771, DIČ CZ27558771, entered in the Commercial Register kept by the Regional Court in Hradec Králové, section C, insert 25963 (hereinafter "the provider") and the user of the website stopyvsrdci.cz (hereinafter "the user").

These terms and conditions form an integral part of the contract concluded between the provider and the user of the service.

2. Description of the service

The provider operates the remembrance portal Stopy v srdci, which makes it possible to create digital remembrance profiles – memorials.

The service makes it possible to:

  • Create and manage remembrance profiles of deceased persons (memorials)
  • Add up to 18 photographs to the gallery (each with a caption), texts, audio and video recordings to the memorials
  • Create animations of photographs using a modern AI tool built into our website
  • Generate QR codes for access to the memorials
  • Have a glass plaque made with an engraved QR code in a restrained design

Creating an account and basic memorials is free of charge; making them available to the public and other services are charged for according to the current price list.

3. Prices and payment terms

3.1 Price list of the services

  • Basic activation of a QR code with three memorials: 3 390 Kč
  • Activation of a QR code + three memorials with a glass plaque: 3 990 Kč
  • Delivery of the glass plaque:
    • DPD Private: 150 Kč
    • DPD Pickup: 69 Kč
  • Activation of each additional memorial (from the fourth): 499 Kč
  • Credit for animating a photograph: 99 Kč
  • A package of 3 animation credits: 200 Kč
  • A package of 10 animation credits: 500 Kč

The prices are given including VAT and are valid at the moment of the order. The provider reserves the right to change the prices of the services. A change of price does not affect contracts already concluded.

3.2 Duration of the service

Activation of the service is a one-off payment for a period of 10 years from the date of activation. The provider undertakes to duly pay the fees for hosting and domain services during this period. The service does not renew automatically and requires no further payments once this period has passed.

3.3 Payment methods

The user can pay for the services in the following ways:

  • Online payment through the GoPay payment gateway
  • By bank transfer to the provider's account

In the case of payment by bank transfer, the services are activated once the amount has been credited to the provider's account.

3.4 Invoicing

The user agrees to the issuing and sending of an electronic invoice to the e-mail address given at registration. The invoice is also always available to download in the user profile, in the orders section.

3.5 Production and delivery of glass QR codes

The glass plaques with an engraved QR code are made directly by the provider on its own production equipment. Each one is made to order from toughened light grey glass in a restrained design with golden ornaments and a contrasting black QR code.

The delivery time may depend on how busy production currently is and may take more than a week. Delivery of the glass plaque does not in any way restrict memorials that have already been activated, which are available immediately after the activation has been paid for.

4. The ordering process and conclusion of the contract

The process of ordering the services takes place as follows:

  1. The user registers on the website stopyvsrdci.cz using an e-mail address, or through a Google, Facebook or Seznam.cz account
  2. The user creates a QR code and the required number of memorials in the user interface
  3. Once the memorials have been prepared, the user selects the activation option and chooses the required type of service
  4. The user confirms the order, thereby expressing agreement with these terms and conditions
  5. The user makes the payment using the chosen payment method
  6. Once the payment has been received, the ordered services are activated automatically and one credit for animating a photograph is allocated

The contract between the provider and the user is concluded at the moment the user confirms the order. All memorials are created to order according to the user's requirements.

4.1 Withdrawal from the contract

Given the nature of the service, which consists of digital content and services provided to order according to the user's requirements, it is not possible under Section 1837(d) and (l) of Act No. 89/2012 Coll., the Civil Code, to withdraw from the contract and request a refund. The user acknowledges and agrees that by activating the service they lose the right to withdraw from the contract.

5. Rules for using the service

5.1 Permitted content

The user undertakes not to publish the following in the memorials:

  • Content breaching the laws of the Czech Republic or international law
  • Erotic, pornographic or otherwise inappropriate content
  • Content inciting violence or racial, religious or other intolerance
  • Content damaging the good name of third parties
  • Content infringing copyright or other intellectual property rights
  • Untrue, deceptive or misleading information

5.2 Checking of content

The provider reserves the right to check the content of memorials at random and, if a breach of these terms is found, to deactivate access to the memorial temporarily. The user will be informed of the deactivation of the memorial by e-mail.

5.3 Copyright

The user declares that they are entitled to publish all the content they upload to the memorials, in particular that they hold the necessary copyright or the consent of the copyright holders. This also applies to photographs used for creating animations with the AI tool.

Should the provider receive a notice of copyright infringement, it will proceed as follows:

  1. It will call on the user to remove the content infringing copyright
  2. If the user takes no action, the provider is entitled to remove this content from the memorial
  3. In the case of repeated copyright infringement, the provider may deactivate the entire memorial

The provider bears no responsibility for the payment of copyright fees or any compensation to copyright holders.

5.4 Use of credits for animations

Creating animations of photographs with the built-in AI tool requires credits, which the user obtains on activating a memorial (1 credit) or by purchasing them. Each credit entitles the user to create one animation. Credits are non-transferable, tied to a particular user account and have no set expiry date.

6. Liability and warranties

6.1 Liability of the provider

The provider undertakes to keep the service running and to ensure its availability, with the exception of necessary technical downtime, of which it will inform the user.

The provider is not liable for:

  • Content uploaded by users to the memorials
  • Damage caused by inappropriate or unlawful use of the service
  • Temporary unavailability of the service as a result of maintenance or technical problems
  • Errors caused by using the service contrary to its purpose

6.2 Liability of the user

The user bears full responsibility for:

  • All content they upload to the memorials
  • Obtaining the consent of persons whose personal data they publish in the memorials
  • Observing copyright in the uploaded content and in photographs used for animations
  • Keeping their access details secure

6.3 Warranty on glass QR codes

The provider gives a standard 24-month warranty on the glass plaques with an engraved QR code, covering defects in materials and workmanship. The warranty does not cover mechanical damage caused by incorrect handling or installation.

The provider guarantees that the 3M VHB 4991B adhesive supplied is UV stable and suitable for outdoor use. To ensure the longest possible life, the surface must be thoroughly cleaned and degreased before application.

7. Changes to the terms and conditions

The provider reserves the right to change these terms and conditions. Changes will be announced to users by e-mail and by publishing the new wording on the website.

If the user does not agree with the changes, they have the right to stop using the service. Continuing to use the service after the changes have been announced is considered agreement with the new wording of the terms and conditions.

8. Protection of personal data

The provider processes the personal data of users in accordance with the GDPR. Detailed information is given in the document Privacy policy.

In connection with the processing of personal data, the user has the following rights:

  • The right of access to personal data
  • The right to have inaccurate data corrected or completed
  • The right to erasure (to be forgotten) if the data is no longer needed
  • The right to restriction of processing
  • The right to data portability (to obtain the data in a structured format)
  • The right to object to processing, in particular for the purposes of direct marketing

9. Final provisions

These terms and conditions are governed by the law of the Czech Republic, in particular by Act No. 89/2012 Coll., the Civil Code.

Should any provision of these terms and conditions be or become invalid, the remaining provisions remain valid and effective.

All disputes arising in connection with the provision of services under these terms and conditions will be resolved primarily by amicable means.

If a consumer dispute arises that cannot be resolved by mutual agreement, the consumer may submit a proposal for out-of-court resolution to the designated body:

These terms and conditions take effect on 30.08.2026.
